Statement of the Legal Directorate and Public Relations of the University of Tirana.

In relation to the last two hearings held at the Tirana Administrative Court of Appeal for the UT Rector's claim against VKM, which passes the Botanical Garden owned by the Municipality of Tirana, we inform you that: respectively on 29.10.2019 and 14.11.2019. XNUMX, the Tirana Administrative Court of Appeal considered the requests of the defendants:

of the Council of Ministers, MASR and Tirana Municipality for the illegitimacy of the Rector in filing the lawsuit with the object: Repeal of the VKM that passes the Botanical Garden owned by the Municipality of Tirana and the declaration of incompetence of the Tirana Administrative Court of Appeal in
consideration of this matter.

In the session of 29.10. 2019, the Tirana Administrative Court of Appeal rejected the request of the State Attorney's Office at the Prime Minister's Office, MASR and the Tirana Municipality, establishing the legitimacy of the Rector of the University of Tirana in filing the lawsuit with the object: Repeal of VKM that passes the Botanical Garden owned by the Municipality of Tirana.

While in today's session dated 14.11. 2019, the Tirana Administrative Court of Appeal decided: The declaration of incompetence and sending the case for trial to the Tirana Administrative Court of First Instance.

According to the above, the lawsuit filed by the UT Rector against the VKM that crosses the Botanical Garden owned by the Municipality of Tirana will be judged by the Administrative Court of the First Instance of Tirana.

The Administrative Court of Appeal did not dismiss the lawsuit of the UT Rector, but determined the functional competence.
