abstract
This dissertation examines the public enforcement of competition rules in the European Union and the challenges of its transposition in Albania, combining a comparative and multidisciplinary analysis. The main objective of the study is to analyze how the European Union has developed a consolidated legal and institutional framework for the protection of competition, to what extent Albania has achieved a factual approximation in this area, and what it can improve in the future. The role of the European Commission and the national competition authorities of the EU Member States are seen from a comparative perspective with the Competition Authority in Albania, highlighting similarities, challenges and needs for improvements. The study analyzes the draft law on changes to the competition regulatory framework in Albania, as well as performs a statistical processing of the Competition Authority’s data, reaching concrete conclusions and proposing effective recommendations for improvements. Finally, the study poses future challenges, including the integration of competition rules with civil and criminal law, human rights and the innovations of digitalization and the use of artificial intelligence. This study aims to contribute to both the academic literature and the practical debates on Albania’s legal and institutional approximation with the EU, emphasizing that the protection of competition through public policies is a fundamental element and a conditio sine qua non for the functioning of the free market.

Last, the study poses future challenges, including the possible clashes of competition law with civil and criminal law, human rights and with the innovations of digitalization and the use of artificial intelligence. This study aims to contribute to both the academic literature and the practical debates on Albania's legal and institutional approximation with the EU, emphasizing that the protection of competition through public policies is a fundamental element and a conditio sine qua non for the democratic functioning of the market.
