Abstrakti: Vëmendja në rritje mbi të drejtat e PAK-ëve gjatë dekadave të fundit ka diktuar nevojën për transformimin e modeleve të vlerësimit të AK në mbarë botën, përfshirë Shqipërinë. Në kuadër të harmonizimit të legjislacionit dhe politikave me parimet e Konventës së OKB-së për të drejtat e PAK-ëve, si dhe nevojës për adresimin e çështjeve të efektivitetit dhe efiçencës në programin e mbrojtjes sociale, Shqipëria nisi zyrtarisht zbatimin e modelit biopsikosocial të vlerësimit të AK rreth fundit të vitit 2019. Reformimi rrënjësor i modelit të vlerësimit përligji nevojën për kryerjen së këtij studimi që synon të analizojë zbatimin e modelit biopsikosocial të vlerësimit në Shqipëri nëpërmjet eksplorimit të risive dhe sfidave të ndeshura nga profesionistët e KSHVAK-ve, PAK-ët dhe personat kyç. Nxjerrja e përfundimeve të studimit u mbështet mbi një metodologji cilësore që ndërthuri intervistat gjysëm të strukturuara me 25 profesionistë, 20 PAK-ë dhe 5 persona kyç me analizën kritike të kuadrit ligjor, institucional dhe strategjik lidhur me zbatimin e modelit biopsikosocial. Gjetjet e studimit sugjerojnë se modeli biopsikosocial i vlerësimit të AK shënon një zhvendosje rrënjësore nga një model që vlerëson diagnozën në një model që vlerëson funksionimin. Ky model, nëpërmjet ngritjes së ekipeve shumëdisiplinore me mjekë dhe punonjës socialë, e ka bërë holistik vlerësimin e AK dhe ka rikonceptuar nga themeli modelin e mbështetjes për PAK-ët përmes ndërthurjes së pagesave me shërbimet e integruara, që ofrohen në përputhje me nevojat individuale të çdo PAK-u. Megjithatë përmbushja e vizionit ambicioz për rritjen e pjesëmarrjes së PAK-ëve në shoqëri kufizohet nga pamjaftueshmëria dhe qasja e kufizuar në shërbime, veçanërisht në zonat rurale, si dhe angazhimi i strukturave publike të shërbimeve të integruara. Nga ana tjetër, pagesat nuk arrijnë të mbulojnë në mënyrë efektive nevojat e shumta të fëmijëve dhe të rriturve me AK. Sfidat sugjerojnë nevojën për pasurimin e shportës së shërbimeve në nivel kombëtar, angazhimin dhe mirëkoordinimin mes strukturave, si dhe rivlerësimin e masës së mbështetjes për fëmijët dhe të rriturit me AK, në mënyrë që të garantohet një nivel dinjitoz jetese dhe integrim në shoqëri.

Abstract: The increasing focus on the rights of persons with disabilities (PwDs) in recent decades has led to the need to transform disability assessment models worldwide, including in Albania. Within the framework of harmonising legislation and policies with the principles of the UN Convention on the PwDs, as well as addressing issues of effectiveness and efficiency in the social protection programme, Albania initiated the implementation of the biopsychosocial model towards the end of 2019. The fundamental reform of the assessment model justified the need to undertake this study, which aims to analyse the implementation of the biopsychosocial assessment model in Albania by exploring the innovations and challenges encountered by multidisciplinary team professionals, PwDs, and key informants. The study’s findings are based on a qualitative methodology combining semi-structured interviews with 25 professionals, 20 PwDs, and 5 key informants, alongside a critical analysis of the legal, institutional, and strategic framework related to the implementation of the biopsychosocial model. The findings suggest that the biopsychosocial model of disability assessment marks a fundamental shift from a diagnosis-based model to a functioning-based model. Through the establishment of multidisciplinary teams composed of doctors and social workers, this model has made disability assessment more holistic and has fundamentally reconceptualised the support model for PwDs by linking cash benefits with integrated services provided in accordance with the individual needs of each individual. However the fulfilment of the ambitious vision to increase the participation of PwDs in society is constrained by the insufficient availability and limited accessibility of services, particularly in rural areas, as well as the limited engagement of public institutions responsible for integrated service provision. On the other hand, financial benefits do not effectively cover the needs of children and adults with disabilities. These challenges highlight the need to expand the service package at the national level, ensure effective engagement and coordination among institutions, and reassess the level of support for children and adults with disabilities in order to guarantee a dignified standard of living and full social inclusion.

Abstrakti: Ky studim analizon proceset e integrimit të emigrantëve shqiptarë në Itali dhe Gjermani pas vitit 1990, duke ofruar një pasqyrë krahasuese të përvojave dhe sfidave të tyre në dy shoqëri pritëse me tradita dhe struktura institucionale të ndryshme. Emigracioni shqiptar ka njohur një rritje të ndjeshme ndër vite, duke kaluar nga emigrantë kryesisht të pakualifikuar në një përbërje më të larmishme që përfshin profesionistë dhe studentë. Italia dhe Gjermania përfaqësojnë destinacione historike dhe aktuale, me modele të ndryshme integrimi: Italia ofron një integrim social më të butë dhe më të lidhur me komunitetin, por me kufizime në tregun e punës, ndërsa Gjermania siguron mundësi më të strukturuara për integrim ligjor dhe ekonomik, por përballet me distanca kulturore dhe sociale më të mëdha. Analiza mbështetet në metodologjinë cilësore, duke gërshetuar rishikimin e literaturës me 50 intervista me emigrantë shqiptarë që jetojnë dhe punojnë në Itali dhe Gjermani, si dhe 6 intervista me specialistë të emigracionit. Studimi përdor konceptet e integrimit, ankorimit social dhe kapitalit social për të shqyrtuar mënyrën se si emigrantët ndërveprojnë me institucionet, tregun e punës dhe komunitetet pritëse. Rezultatet tregojnë se integrimi ndikohet nga gjinia, arsimi, punësimi, njohja e gjuhës dhe rrjetet sociale. Sfidat kryesore përfshijnë dallimet kulturore, pengesat burokratike, izolimin social dhe vështirësitë gjuhësore, ndërsa lehtësitë lidhen me mundësitë për zhvillim dhe një sistem të perceptuar si meritokratik. Integrimi paraqitet si proces dinamik dhe relacional, me dallime të dukshme midis Italisë dhe Gjermanisë që burojnë nga modelet dhe kushtet e ndryshme të integrimit. Studimi sugjeron që Republika e Shqipërisë të luajë një rol aktiv përmes bashkëpunimit me shoqatat e diasporës dhe promovimit të identitetit kulturor, ndërsa Italia dhe Gjermania të forcojnë politikat integruese përmes përmirësimit të aksesit në tregun e punës, njohjes së kualifikimeve, përforcimit të integrimit gjuhësor dhe arsimor dhe luftës kundër diskriminimit. Bashkëpunimi shumënivelësh ndërmjet institucioneve shtetërore, organizatave të emigrantëve dhe shoqërisë civile identifikohet si një faktor kyç për krijimin e politikave më efektive dhe gjithëpërfshirëse. Në këtë kuadër, integrimi i emigrantëve shqiptarë shihet si një proces i përbashkët përgjegjësie ndërmjet vendit të origjinës dhe vendeve pritëse, që kontribuon në mirëqenien individuale, kohezionin social dhe zhvillimin e qëndrueshëm të shoqërive përkatëse

Abstract: This study examines the integration processes of Albanian migrants in Italy and Germany after 1990, offering a comparative perspective on their experiences and challenges in two host societies with distinct traditions and institutional structures. Over time, Albanian migration has shifted from predominantly low- skilled migrants to a more diverse population that includes professionals and students. Italy and Germany serve as both historical and contemporary destinations, with differing integration models: Italy provides softer social integration closely linked to the community but faces labor market limitations, while Germany offers structured legal and economic integration opportunities, yet exhibits greater cultural and social distances. The research employs a qualitative methodology, combining literature review with 50 interviews with Albanian migrants and six interviews with migration specialists. Key concepts such as integration, social anchoring, and social capital are used to analyze how migrants interact with institutions, the labor market, and host communities. Findings indicate that integration is influenced by gender, education, employment status, language proficiency, and social networks. The main challenges include cultural differences, bureaucratic barriers, social isolation, and language difficulties, while facilitating factors are mainly related to opportunities for personal and professional development and a system perceived as meritocratic. Integration emerges as a dynamic and relational process, with notable differences between Italy and Germany stemming from their distinct integration models and conditions. The study recommends that the Republic of Albania take an active role by collaborating with diaspora associations and promoting cultural identity, while Italy and Germany strengthen integration policies through improved labor market access, recognition of foreign qualifications, language and educational support, and anti- discrimination measures. Multi-level cooperation among state institutions, migrant organizations, and civil society is crucial for designing effective and comprehensive policies. Overall, the integration of Albanian migrants is framed as a shared responsibility between the country of origin and host countries, contributing to individual well-being, social cohesion, and sustainable development

Abstrakti: Ky disertacion eksploron sfidat dhe mundësitë në trajtimin juridik të pronësisë industriale nën këndvështrimin e së drejtës ndërkombëtare private, duke u fokusuar në juridiksionin dhe ligjin e zbatueshëm për markat dhe patentat. Parimi i territorialitetit analizohet si një shtyllë themelore që rregullon krijimin dhe mbrojtjen e këtyre të drejtave, duke nxjerrë në pah kufizimet që dalin në kontekste ndërkombëtare dhe rastet trans-nacionale. Pjesa qendrore e punimit trajton juridiksionin ekskluziv për regjistrimin dhe vlefshmërinë e të drejtave të pronësisë industriale, duke u bazuar në rregulloret e BE-së si Rregullorja e Brukselit Ia dhe instrumente ndërkombëtare si Konventa e Parisit dhe Marrëveshja TRIPS. Disertacioni identifikon mangësitë në harmonizimin ndërkombëtar dhe konfliktet që lindin nga interpretimi i ndryshëm i ligjeve kombëtare. Në mënyrë të veçantë, analiza thekson rëndësinë e ligjit të zbatueshëm në përcaktimin e të drejtave dhe detyrimeve të palëve, duke u fokusuar në rolin e vendit të regjistrimit si faktori kryesor përcaktues. Gjithashtu, diskutohen rastet gjyqësore më të rëndësishme dhe jurisprudenca për të ilustruar kompleksitetin e këtyre çështjeve. Në epokën dixhitale, disertacioni adreson sfidat që vijnë nga shkeljet online të të drejtave të pronësisë industriale dhe propozon reforma ligjore për të trajtuar këto problematika. Rekomandimet përfshijnë nevojën për harmonizim më të mirë ndërkombëtar, forcimin e legjislacionit shqiptar dhe zhvillimin e qasjeve të reja përmes mekanizmave të specializuar ndërkombëtarë. Ky disertacion përfaqëson një kontribut të rëndësishëm në fushën e së drejtës ndërkombëtare private, duke ofruar udhëzime praktike dhe teorike për zhvillimin e mëtejshëm të kuadrit juridik të pronësisë industriale.

Abstract: This dissertation explores the challenges and opportunities in addressing the legal aspects of industrial property under the perspective of private international law, focusing on jurisdiction and the applicable law for trademarks and patents. The principle of territoriality is analysed as a fundamental pillar governing the creation and protection of these rights, highlighting the limitations arising in international contexts and transnational cases. The central part of the dissertation examines exclusive jurisdiction for the registration and validity of industrial property rights, drawing upon EU regulations such as the Brussels I Regulation and international instruments like the Paris Convention and the TRIPS Agreement. The dissertation identifies gaps in international harmonization and conflicts arising from differing interpretations of national laws. In particular, the analysis underscores the importance of applicable law in determining the rights and obligations of the parties, emphasizing the role of the place of registration as the primary determining factor. Additionally, significant case law and jurisprudence are discussed to illustrate the complexity of these issues. In the digital era, the study addresses challenges arising from online infringements of industrial property rights and proposes legal reforms to tackle these issues. The recommendations include the need for improved international harmonization, strengthening Albanian legislation, and developing new approaches through specialized international mechanisms. This dissertation represents a significant contribution to the field of private international law, offering practical and theoretical guidance for the further development of the legal framework for industrial property.

Abstrakti: ABSTRAKT Kontrata e sigurimit dhe ajo e sigurimit të pasurisë në veçanti përbën një nga kontratat tipike të parashikuara në Kodin Civil të Republikës së Shqipërisë. Për shkak të zhvillimeve historike, të cilat kanë imponuar ndryshimin e regjimeve politike dhe ekonomike përgjatë shekullit XX, legjislatura të ndryshme kanë miratuar rishtazi legjislacionin e tyre civil që i është përshtatur zhvillimeve të kohës. Kontrata e sigurimit ka gjetur rregullim në Kodin Tregtar të Mbretërisë Shqiptare që i përket periudhës së mbretit Zog, në ligjin nr.2359, datë 15.11.1956 “Mbi Veprimet Juridike dhe mbi Detyrimet” si dhe Kodin Civil të Republikës Popullore Socialiste të Shqipërisë të vitit 1981, si dhe në Kodin Civil të Republikës së Shqipërisë të vitit 1994 në fuqi edhe sot. Kontrata e sigurimit të pasurisë gjen rregullim në tridhjetë e gjashtë dispozita. Kodi Civil i Republikës së Shqipërisë pasqyron të drejtat dhe detyrimet e palëve kontraktore, duke përbërë një bazë të mjaftueshme për zhvillimin e tregut të sigurimeve në Shqipëri. Qëllimi i këtij punimi është që të kryejë një analizë krahasimore, duke nisur me një përmbledhje në lidhje me ndryshimet që ka pësuar kontrata e sigurimit të pasurisë në historinë legjislative të vendit tonë, si dhe duke ballafaquar legjislacionin civil në lidhje me kontratën e sigurimit të pasurisë në të drejtën civile të Kosovës, Italisë dhe Gjermanisë. Gjithashtu punimi ndalet në analizën e kontratës së sigurimit të pasurisë me elementë të huaj dhe disa përfundime të Komisionit Europian mbi kontratën e sigurimit në vende të Bashkimit Europian. Ballafaqimi i këtyre tri modeleve legjislative mbi kontratën e sigurimit të pasurisë dhe përfundimeve të Komisionit Europian vlen për nxjerrjen e disa rekomandimeve duke sugjeruar përmirësime të mëtejshme të kontratës së sigurimit të pasurisë në legjislacionin shqiptar.

Abstract: The insurance contract and the property insurance contract in particular constitute one of the typical contracts provided for in the Civil Code of the Republic of Albania. Due to historical developments, which have imposed changes in political and economic regimes throughout the 20th century, various legislatures have recently adopted their civil legislation that has adapted to the developments of the time. The insurance contract has found regulation in the Commercial Code of the Albanian Kingdom dating back to the period of King Zog, in Law No. 2359, dated 15.11.1956 “On Legal Actions and Obligations” as well as the Civil Code of the Socialist People’s Republic of Albania of 1981, and in the Civil Code of the Republic of Albania of 1994 still in force today. The property insurance contract finds regulation in thirty-six provisions. The Civil Code of the Republic of Albania reflects the rights and obligations of the contracting parties, constituting a sufficient basis for the development of the insurance market in Albania. The purpose of this paper is to conduct a comparative analysis, starting with a summary of the changes that the property insurance contract has undergone in the legislative history of our country, as well as comparing the civil legislation regarding the property insurance contract in the civil law of Kosovo, Italy and Germany. The paper also focuses on the analysis of the property insurance contract with foreign elements and some conclusions of the European Commission on the insurance contract in European Union countries. The comparison of these three legislative models on the property insurance contract and the conclusions of the European Commission is valid for issuing some recommendations by suggesting further improvements to the property insurance contract in Albanian legislation.

Abstrakti: Ky disertacion analizon krimin e organizuar dhe korrupsionin, si fenomene që ndikojnë në mënyrë të drejtpërdrejt në konsolidimin e shtetit të së drejtës si dhe në funksionimin e rendit juridik. Disertacioni analizon në mënyrë teorike dhe krahasuese format bashkëkohore të krimit të organizuar, marrëdhënien e tij me korrupsionin si dhe pasojat juridike që burojnë nga kjo marrëdhënie. Ky disertacion evidenton se krimi i organizuar nuk kufizohet vetëm në veprimtari të dukshme kriminale por ai shfaqet gjithnjë e më shumë përmes grupeve kriminale që përdorin mekanizma të sofistikuar, të cilët shfrytëzojnë korrupsionin për të ndikuar në proceset vendimmarrëse dhe në zbatimin e ligjit. Korrupsioni analizohet si një fenomen që prek të gjithë sistemin, duke cenuar parimet e ligjshmërisë, sigurisë juridike dhe të barazisë para ligjit. Në këtë kuadër, disertacioni evidenton rolin e “corruption proofing” si një mekanizëm parandalues juridik, i cili ka si qëllim identifikimin dhe zvogëlimin e rreziqeve të korrupsionit në procesin e hartimit të legjislacionit. Në përfundim, ky disertacion analizon kuadrin ligjor ndërkombëtar, atë kombëtar si dhe kuadrin institucional dhe legjislacionin e disa vendeve evropiane dhe në rajon duke nxjerrë në pah rëndësinë e tyre në luftën kundër krimit të organizuar dhe korrupsionit

Abstract: This dissertation analyzes organized crime and corruption, as a phenomena that directly affect the consolidation of the rule of law and the functioning of the legal order. The dissertation analyzes theoretically and comparatively contemporary forms of organized crime, its relationship with corruption, and the legal consequences that stem from this relationship. This paper highlights that organized crime is not limited to obvious criminal activities, but it increasingly appears through criminal groups that use sophisticated mechanisms, which exploit corruption to influence decision-making processes and law enforcement. Corruption is analyzed as a phenomenon that affects the entire system, violating the principles of legality, legal certainty, and equality before the law. In this context, the dissertation highlights the role of “corruption proofing” as a preventive legal mechanism, which aims to identify and reduce the risks of corruption in the process of drafting legislation. In conclusion, this dissertation analyzes the international legal framework, the national legal framework, as well as the institutional framework and legislation of several European countries and in the region, highlighting their importance in the fight against organized crime and corruption

ABSTRAKT

Punimi evidenton marrëdhënien mes klimën sociale në shkollën e mesme shqiptare me nivelin e bullizmit tradicional dhe kibernetik si dhe marrëdhënien që ka klima sociale e shkollës me bullizmin, shëndetin mendor, vetvlerësimin dhe kënaqësinë nga jeta të nxënësve adoleshentë në sistemin arsimor parauniversitar në Shqipëri. Hulumtimi mundëson ndërtimin e një shkalle krahasuese mes sistemit parauniversitar shqiptar me sistemet parauniversitare të vendeve të ndryshme, mbi marëdhëniet mes klimës sociale të shkollës me problemin e bullizmit dhe shëndetin mendor, vetvlerësimin dhe kënaqësinë nga jeta të nxënësve të kësaj grupmoshe.

Punimi u realizua nëpërmjet një sondazhi korelacional kros–seksional, bazuar në plotësimin e instrumentit me bazë shkolle. Ai koreloi disa variabla si klima sociale e shkollës, bullizmi tradicional dhe kibernetik në shkollë, shëndeti mendor, depresioni, vetvlerësimi dhe kënaqësia nga jeta e nxënësve shqiptar. Analiza statistikore dhe sasiore përfaqëson vlerësimin e këtyre variablave midis nxënësve adoleshent në shkollën e mesme shqiptare. Disenjmi punimit ndjek standartet metodologjike ndërkombëtare. Instrumenti u plotësua nga 1056 nxënës në shkollën e mesme shqiptare, nga klasa e 6-të deri tek klasa e 12-të, mosha 12 deri 18 vjec.

Disa nga rezultatet kryesore të punimit tregojnë se ka marrëdhënie negative midis klimës sociale në shkollë dhe bullizmit, duke evidentuar se klima sociale është parashikues i fuqishëm i mirëqenies psikologjike, ndërkohë që viktimizimi nga bullizmi shfaqet si faktor rreziku. Ka marrëdhënie pozitive mes klimës sociale dhe vetvlerësimit duke rezultuar klima sociale në shkollë si parashikuesi i vetëvlerësimit.Gjithashtu ka marrëdhënie negative mes klimës sociale në shkollë dhe shfaqjes së simptomave të depresionit, duke treguar sesa më i madh të jetë niveli klimës sociale në shkollë, aq më shumë do të reduktohen shfaqjet e simptomave të depresionit te nxënësit adoleshent. Ndërkohë ka marrëdhënie negative mes përfshirjes së nxënësve në bullizëm dhe vetvlerësimit të nxënësve adoleshent duke shfaqur viktimizimi apo ushtrimi bullizmit tradicional dhe kibernetik ulje të vetëvlerësimit te nxënësitadoleshent

Klima sociale pozitive në shkollë është faktor i rëndëshishëm për reduktimin e nivelit të bullizmit në shkollë dhe rritjen e vetëvlerësimit dhe shëndetit mendor të nxenësve adoleshent si dhe në reduktimin e simptomave depresive te nxënësit. Klima sociale pozitive në shkollën e mesme shqiptare, produkt i rritjes profesionale të strukturave drejtuese të shkollës, rritjes angazhimit të komunitetit të prindërve në problemet e shkollës, menaxhimit efektiv të konfliktit shkollor, fuqizimit të rolit të shërbimit psikosocial në shkollë, etj.

ABSTRACT

This study aims to examine the relationship between the social climate in Albanian secondary schools and the prevalence of traditional and cyber bullying, as well as the relationship between school social climate and bullying, mental health, self-esteem, and life satisfaction among adolescents within the Albanian pre-university education system and give a comparative framework between the Albanian pre-university educational system and those of other countries. 

The study was conducted through a cross-sectional correlational survey design based on the administration of a school-based research instrument. It examined the interrelationship among several variables, including school social climate, traditional bullying, cyberbullying, mental health, depressive symptoms, self-esteem, and life satisfaction among Albanian students. Statistical and quantitative analyses were employed to assess these variables among adolescent students attending Albanian secondary schools. The study design follows internationally recognized methodological standards. The instrument was completed by 1,056 students from grades 6 through 12, aged between 12 and 18 years. 

Findings indicate a significant negative relationship between school social climate and bullying, demonstrating that a positive school social climate serves as a strong predictor of psychological well-being, whereas bullying victimization emerges as a substantial risk factor. The results also reveal a positive relationship between school social climate and self-esteem, suggesting that school social climate significantly predicts students’ levels of self-esteem. Furthermore, a negative relationship was identified between school social climate and depressive symptoms, indicating that higher levels of positive school social climate are associated with lower manifestations of depressive symptoms among adolescent students. In addition, the study identified a negative relationship between involvement in bullying and self-esteem, showing that both victimization and perpetration of traditional and cyberbullying are associated with decreased self-esteem among adolescents. 

A positive school social climate constitutes an important protective factor in reducing bullying and enhancing adolescents’ self-esteem and mental health, while simultaneously contributing to the reduction of depressive symptoms among students. The development of a positive social climate in Albanian secondary schools is closely associated with the professional development of school leadership structures, increased parental community engagement in school-related issues, effective conflict management within schools, and the strengthening of psychosocial support services in the educational environment.
