Project: Justice Programme

Justice Programme: This program contributes to further development of a European justice zone, based on reciprocal recognition and reciprocal trust, promoting the judiciary cooperation in civil and criminal issues; it helps with judges and other legal practitioners training; facilitates the effective access of individuals and businesses all over Europe to justice, including linguistic training on legal terminology, aiming to encourage a joint legal and judiciary culture, an effective access in justice in Europe, including the crime victims’ rights and the procedural rights in the criminal proceedings, initiatives in the field of drugs policies (judiciary cooperation and crime prevention aspects).

 

Title: Diversity of Enforcement titles in cross-border debt collection in the EU, – EU_EN4S

Set objectives:

  • Promoting mutual trust between the administrations of justice member states;
  • Contribution to understand differences in the structure content and judgment effects in the member states regarding the selection and impact of this process of cross-border borders implementation;
  • Contribution to comparative research of different application titles dogmatic and empirical concepts regarding recognition and implementation;
  • The means to start the foreign implementation for different implementation systems;
  • Establishing an expert vocabulary to reduce terminology obstacles;
  • Improve judiciary information regarding the beginning and the competence of the execution titles.

Expected outputs include:

  • Increasing the executing authorities knowledge and understanding on the foreign execution titles;
  • Increasing the mutual trust between the executing authorities in different member states;
  • Increasing the use of individual border execution;

 Activities:

  • Expert comparative research work;
  • Knowledge exchange, capacities and awareness increase;
  • Processing the oracle of the European execution title;
  • Pilot activities: automatizing execution procedures.

Title: Enhancing Enforcement under Brussels Ia,EN2BRIa

The main objective of the project is to shed light through relevant data collection on the conditions through which the relations between Regulations No. 1215/2012 (Brussels la) and other EU law instruments to investigate the impact of the abovementioned issue on the effective implementation of the EU acquis law regarding judiciary cooperation in the civil cases and to effectively execute the verdicts in the context of the gathered jurisprudence, in accordance with the summons priority.

The expected outputs include:

  • increasing the interns capacities to address issues related to judiciary cooperation in business and civil cases, especially regarding the execution.
  • Increasing awareness in the practical and institutional level regarding the complexity of relationships between the Brussels la Regulations and other EU institutions;
  • improving the legal framework and regulations related to judiciary cooperation in civil cases through identifying the possible solutions to facilitate examined criticisms.

Activities:

  • Gathering all the national relevant jurisprudence and that of European Court of Human Rights (ECHR);
  • The analysis of decisive cases related to the interaction between the Brussels Regulation and other EU law instruments;
  • Organization of the Final International Conference;
  • Organization of the workshops (Genova and Tirana);
  • Drafting a manual;
  • Drafting recommendations to political institutions;
  • Drafting instructions to legal practitioners;
  • Creating the project website.

Title: Train to enforce, – Train 2 EN4CE

This project addresses the need for qualified law practitioners (judges, lawyers), well-informed, and able regarding the implementation and functionality of the EU procedural law (EOPP and ESCP) Furthermore, the project addresses the gaps in the legal language training, as the English legal terminology training will be included in the activities.

The project general objectives can be identified on the equipment of judges and lawyers with knowledge and skills needed for the EU procedural law updated mechanisms adequate and efficient implementation related to cross-border debt collection. The project will contribute on increasing the mutual trust in cross-border justice, facilitating the reduction of inequality between Member States.

Project objectives:

  • Provide the judges and lawyers with free of charge, interactive and practice-oriented training in a multi-language and international manner, applying the modern technology benefiting the outcomes long-term sustainability.
  • The main goal of the training is to increase the knowledge of the trainees on the EU civil law, especially EOPP and ESCP.
  • The training will focus on the best updated practices regulated for the trainers identified needs to equip them exclusively with the most relevant and important methods of the two Regulations implementation.
  • The training will be provided in each of the involved Member States from teams of trainers of academic background, who will submit to exchange visits in other involved Member States to hasten the understanding and transfer or the best practices to comparative environments and to strengthen the mutual trust between the legal practitioners in the cross-border judiciary cooperation.
  • The training will include instructions on the respective legal terminology in English to promote a uniform understanding of the Regulations and overcome linguistic barriers.
  • The publication of training materials and project outputs in the project website will encourage the learning of all those concerned regarding the understanding, implementation and the best practice of the mentioned Regulations.
  • Establishing the training network with the EU candidate countries.
  • TRAIN2EN4CE consortium aims to broaden the training providers cross-border network for judges and lawyers. More specifically, the consortium consists of a partnership between universities and branch organizations located in seven different member states.
