ABSTRAKT

 

Ky studim trajton në mënyrë sistematike kuadrin ligjor të Bashkimit Evropian mbi lejen e lindjes dhe lejet e tjera që lidhen me fëmijën, në dritën e doktrinës së mbrojtjes sociale dhe konceptit të rrezikut social. Ai synon të përcaktojë nëse legjislacioni i BE mbi lejen e lindjes reflekton një qasje të vetme të rrezikut social (që lidhet vetëm me mbrojtjen e nënës që lind) apo nëse mund të zhvillohet drejt një qasjeje shumëfishe (MSRA), e cila ndan në mënyrë të qartë mbrojtjen e nënës nga kujdesi për të porsalindurin. 

Në këtë kuadër, studimi vendos në qendër të analizës marrëdhënien midis të drejtës së punës dhe sigurimeve shoqërore si instrumente të mbrojtjes sociale. Leja e lindjes trajtohet jo vetëm si një institucion i mbrojtjes së punëmarrëses shtatzënë, por si një mjet i politikës sociale që përfshin dimensionin ekonomik, shëndetësor dhe gjinor të mbrojtjes së prindërve në tregun e punës.

Metodologjia e përdorur është kryesisht doktrinare dhe analitike, duke u mbështetur në interpretimin sistematik të burimeve primare të së drejtës së BE — përkatësisht Direktiva 92/85/KEE mbi punëmarrëset shtatzëna (PrWD) dhe Direktiva 2010/41/BE mbi vetëpunësimin (SED 2010) — si dhe në legjislacionin për lejen prindërore (Direktiva 2010/18 dhe 2019/1158/BE). Gjithashtu analizohet jurisprudenca udhëheqëse e Gjykatës së Drejtësisë së Bashkimit Evropian, përfshirë çështjet Hofmann, C.D., Z., Roca Álvarez dhe Betriu Montull, të cilat kanë përcaktuar kufijtë ndërmjet mbrojtjes së nënës dhe kujdesit për fëmijën.

Përveç analizës së normave të BE, studimi ndërmerr një krahasim funksional me disa shtete anëtare përfaqësuese (Belgjika, Irlanda, Spanja, Mbretëria e Bashkuar, Suedia dhe Portugalia), si dhe me Shqipërinë si vend kandidat për anëtarësim në BE. Kjo qasje krahasuese synon të hedhë dritë mbi shkallën e harmonizimit material dhe sfidat që dalin në zbatimin praktik të standardeve evropiane mbi mbrojtjen e amësisë dhe prindërimit.

Objektivi kryesor është të sqarojë konceptin e rrezikut social në legjislacionin e BE për lejen e lindjes, të analizojë qëndrueshmërinë e kësaj qasjeje në dritën e argumenteve juridike, mjekësore dhe sociale, si dhe të vlerësojë mundësinë e një qasjeje më të balancuar që reflekton realitetet bashkëkohore të ndarjes së përgjegjësive prindërore.

Studimi kufizohet në analizën juridike të kuadrit evropian dhe të atij shqiptar, pa përfshirë studime empirike ose dimensione ekonomike. Megjithatë, ai krijon bazën për kërkime të mëtejshme mbi mënyrën se si lejet e lidhura me fëmiijët ndikojnë në barazinë gjinore dhe në pjesëmarrjen e prindërve në tregun e punës.

ABSTRACT

 

This study systematically examines the legal framework of the European Union on maternity leave and other child-related leaves through the lens of social protection doctrine and the concept of social risk. It aims to determine whether EU law on maternity leave reflects a single social risk approach (SSRA) — focused exclusively on the protection of the biological mother — or whether it can evolve towards a multiple social risk approach (MSRA), which clearly distinguishes between the protection of the mother and the care of the newborn. 

Within this framework, the study places at its centre the relationship between labour law and social security law as instruments of social protection. Maternity leave is analysed not merely as an institution safeguarding pregnant employees, but as a broader social policy mechanism encompassing the economic, health, and gender dimensions of parental protection in the labour market. 

The research methodology is primarily doctrinal and analytical, relying on the systematic interpretation of the primary sources of EU lawnotably Directive 92/85/EEC on pregnant workers (the PrWD) and Directive 2010/41/EU on self-employed workers (the SED 2010) — together with the legislation on parental leave (Directives 2010/18/EU and 2019/1158/EU on worklife balance). It also draws on the key case-law of the Court of Justice of the European Union, including Hofmann, C.D., Z., Roca Álvarez, and Betriu Montull, which have defined the boundaries between the protection of the mother and care for the child. 

Beyond the normative analysis, the study undertakes a functional comparative approach among selected Member States (Belgium, Ireland, Spain, the United Kingdom, Sweden, and Portugal), as well as Albania as an EU candidate country. This comparative dimension seeks to illuminate the degree of material harmonisation and the challenges in the practical implementation of EU standards on maternity and parental protection. 

The main objective is to clarify the notion of social risk in EU law governing maternity leave, to assess the internal consistency of this approach in light of legal, medical, and social arguments, and to evaluate the potential for a more balanced model that reflects contemporary realities of shared parental responsibilities. 

The study is limited to a legal analysis of the European and Albanian frameworks, without engaging in empirical or economic assessment, but it establishes the conceptual basis for further research on the impact of child-related leaves on gender equality and labour market participation.
